不久前,因一条“不会杀猪求助”视频而走红的呆呆(网名),被网友戏称为2026年“闯祸”第一人,随后一场千人自发帮忙的“刨猪宴”热潮席卷全网()。
然而,热潮退去后,在二手交易平台上,竟有人公然售卖“呆呆家的土”,标价从66.66元至888元不等。
Earlier this year, an internet user known as Daidai went viral after posting a video asking for help butchering a pig. The incident soon led to a spontaneous online movement in which thousands volunteered to help organize a "pig feast" in her name.
However, after the buzz faded, a new online trend emerged: sellers on secondhand trading platforms began offering "soil from Daidai's home" at prices ranging from 66.66 to 888 yuan.
卖家们还打出噱头,称其为“转运土”“风水宝地富贵土”。部分卖家称,数量不多,限一人一两。
中青报·中青网记者私信几位卖家了解情况,当被问及如何保证土确实来自呆呆家时,有卖家表示:“拍视频给你”,也有卖家不予正面回应。
The sellers promoted it as "fortune-attracting soil" or "geomancy blessed earth", claiming it could bring good luck. Some also noted that the supply was limited, with each buyer restricted to a small amount.
When contacted by a China Youth Daily reporter, several sellers were asked how they could verify the soil's origin. One replied, "I can send you a video", while others avoided the question.
在社交平台上,还有当地网友发布视频,视频显示,有人手持锄头在呆呆家门口挖土,也有人提着袋子装土。
据封面新闻报道,相关平台工作人员回应称,目前平台公约尚未明确禁止此类商品的销售。
另据极目新闻消息,1月19日,呆呆所属的当地村委会工作人员表示,已听闻此事,但并未亲眼见到有人挖土售卖。该工作人员同时透露,最近呆呆家门口的人流量已明显减少,加之这两天持续降雨,现场已恢复平静。
On social media, local users posted clips showing people digging soil outside Daidai's home with hoes or filling bags with dirt.
According to Cover News, staff from related platforms have stated that their platforms' current policies do not explicitly prohibit such sales.
Jimu News reported on Monday that staff from Daidai's local village committee said they had heard about the situation but had not witnessed anyone digging or selling soil. They added that the flow of visitors to Daidai's home had recently decreased significantly, and with ongoing rain over the past few days, the area had quieted down.
中国执业律师缪蒙京告诉中青报·中青网记者,售卖“呆呆家的土”涉嫌多重法律风险:
一、如果相关“转运土”不是呆呆家的,则涉嫌欺诈。
二、在耕地或者非耕地取土均需要办理相关行政许可,由申请人事先申报取土用途、取土位置、数量等。在获得许可后,才可以在确定的范围内取土使用。商家未办理合法手续直接取土销售,涉嫌违反《中华人民共和国土地管理法》等法律法规。
三、卖家宣称呆呆家的土是“转运土”,带有封建迷信内容。商家声称的所谓转运没有科学依据,更不符合社会公共道德。《中华人民共和国广告法》第九条第八款明确规定广告不得含有迷信内容。《中华人民共和国消费者权益保护法》第二十条规定,经营者向消费者提供商品的性能、用途等信息应当真实,不得作虚假或者引人误解的宣传。商家以转运为卖点,不仅违反了广告法,而且涉嫌虚假宣传和欺诈,应依法承担包括赔偿消费者损失及行政处罚在内的法律责任。
Lawyer Miao Mengjing told China Youth Daily that selling "soil from Daidai's home" involves multiple legal risks:
If the "fortune soil" does not actually come from Daidai's home, it constitutes fraud.
Removing soil — whether from farmland or other land — requires relevant administrative permits, including declared purpose, location, and quantity. Selling soil without approval violates laws such as the Land Administration Law of the People's Republic of China.
The sellers' claim that the soil can "bring fortune" involves feudal superstition, which lacks scientific basis and contradicts social morality. Such promotions violate the Advertising Law of the People's Republic of China, which prohibits superstitious content, and the Consumer Rights Protection Law, which bans false or misleading advertising. Sellers may face compensation claims and administrative penalties.
缪蒙京呼吁,消费者应当理性对待这种封建迷信行为,自觉抵制这类商品。
值得注意的是,此前曾有人将“银行土”标榜为“聚财”商品进行售卖,引发社会广泛关注与讨论。随后,多个相关平台将“银行土”的视频及商品下架。
